Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Vigyansh platform, including the websites at vigyansh.com and app.vigyansh.com (collectively, the "Service"), operated by Imbine Technologies ("Company," "we," "our," or "us") on behalf of the Vigyansh product.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are under 18 years of age, your parent or legal guardian must accept these Terms on your behalf.

1. Description of Service

Vigyansh is an AI-powered educational tutoring platform designed for Indian students studying under the NCERT (National Council of Educational Research and Training) curriculum, currently covering Class 5 through Class 10. The Service provides:

• AI-guided question answering grounded in NCERT textbooks
• Socratic dialogue to guide students toward understanding concepts
• Interactive visualizations and simulations for Physics, Chemistry, Biology, and Mathematics
• OCR-based input for printed or handwritten questions
• Bilingual support in English and Hindi

2. Eligibility and Account Registration

To use the Service, you must:

• Be at least 10 years of age (approximately Class 5). Users under 18 must have parental or guardian consent.
• Provide a valid email address and create an account
• Provide accurate and complete information during registration
• Maintain the security of your account credentials and notify us immediately of any unauthorized access at contact@vigyansh.com

You are responsible for all activity that occurs under your account. Accounts are non-transferable.

3. Free Access

The Service is currently provided free of charge. We reserve the right to introduce paid plans or features in the future. Any such changes will be communicated in advance with reasonable notice, and free features will remain accessible where operationally feasible.

4. Acceptable Use

You agree to use Vigyansh only for lawful educational purposes. You must not:

• Use the Service to generate academic dishonesty content (e.g., submitting AI-generated work as your own in examinations)
• Attempt to reverse-engineer, scrape, or extract the underlying AI models, NCERT datasets, or proprietary technology
• Upload images or content that are offensive, illegal, or infringe third-party rights
• Attempt to circumvent authentication, security systems, or rate limits
• Use automated bots or scripts to interact with the Service
• Impersonate other users, educators, or Vigyansh staff
• Use the Service in any way that violates applicable Indian laws, including the IT Act 2000 and the DPDP Act 2023

Violation of these rules may result in immediate suspension or termination of your account without notice.

5. AI Limitations and Educational Disclaimer

Vigyansh is an AI-powered tool, not a human teacher. While we work to ensure accuracy and NCERT-alignment, the Service may occasionally produce:

• Incomplete or imprecise explanations
• Errors in mathematical computation or scientific reasoning
• Outdated information where NCERT textbooks are revised

Vigyansh is intended to supplement - not replace - classroom instruction, human teachers, and standard textbook study. For examination preparation, always verify AI responses against your official NCERT textbook. The Company is not responsible for academic outcomes resulting from reliance on the Service.

6. Intellectual Property

All content, technology, designs, and software underlying the Vigyansh platform (excluding NCERT textbook content) are the intellectual property of Imbine Technologies and are protected under applicable Indian intellectual property laws.

NCERT textbook content is reproduced under applicable educational use provisions. NCERT is the copyright holder of its curriculum materials.

You retain ownership of questions and content you submit. By submitting content, you grant us a limited, non-exclusive license to process it to provide the Service and improve AI accuracy on an aggregated, anonymized basis.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

8. Modification of Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable. We will not be liable to you or any third party for such changes.

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or if required by law. You may delete your account at any time by contacting contact@vigyansh.com. Termination does not affect provisions of these Terms that by their nature should survive (e.g., limitation of liability, governing law).

10. Limitation of Liability

To the maximum extent permitted by applicable law, Imbine Technologies and Vigyansh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of academic performance, data loss, or revenue arising from your use of or inability to use the Service.

Our total liability to you for any claim arising under these Terms shall not exceed INR 1,000 (Rupees One Thousand) or the amount you paid us in the 12 months preceding the claim, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Imbine Technologies, its directors, employees, and agents from and against any claims, losses, damages, or expenses (including legal fees) arising out of your violation of these Terms or applicable law.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

Before initiating legal proceedings, you agree to first attempt resolution by contacting our Grievance Officer at contact@vigyansh.com. We will make good-faith efforts to resolve disputes within 30 days.

13. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last Updated" date. Material changes will be communicated via email or a notice on the platform. Your continued use after changes take effect constitutes acceptance of the revised Terms.
